Please read these Terms & Conditions carefully before booking cargo, requesting freight quotations, or utilizing logistics services provided by Shubhak Logistics Private Limited (“Company”, “we”, “our”, or “us”). By requesting a quote, confirming a booking, tendering cargo, or using our website, the customer (“Shipper”, “Consignee”, or “Customer”) accepts and agrees to be bound by these Standard Trading Conditions.

1. Nature of Services & Forwarding Role
Shubhak Logistics operates as a freight forwarding and logistics coordination enterprise. We coordinate, arrange, and contract cargo movement through independent third-party carriers (including ocean shipping lines, airlines, road freight hauliers, customs bonded warehouses, and terminal operators).
Unless explicitly agreed in writing under a specialized carrier contract, the Company acts as an agent in procuring carriage, and all transport remains subject to the contractual terms and conditions of carriage issued by the actual carrying shipping line, airline, or road transporter (as set forth on their respective Bills of Lading, Air Waybills, or Consignment Notes).
2. Shipper Warranties & Declarations
The Customer warrants and declares that:
- All particulars regarding the nature, value, weight, dimensions, packaging, and quantity of the goods provided in shipping documents are accurate and complete.
- Cargo is properly packed, marked, labeled, and prepared to withstand the ordinary risks of multimodal transportation, sea voyages, air transit, and mechanical handling.
- The cargo complies with all applicable statutory export, import, and transit regulations of India and destination countries.
- The Customer possesses all required export/import licenses, authorizations, permits, and tax registrations (such as IEC and GSTIN).
3. Dangerous Goods & Prohibited Cargo
The Customer shall not tender any hazardous, flammable, explosive, radioactive, toxic, or regulated dangerous goods without prior written disclosure and approval by Shubhak Logistics. Where accepted, dangerous goods must strictly conform to IMDG Code (for ocean freight) or IATA Dangerous Goods Regulations (for air freight) and must be accompanied by accurate Material Safety Data Sheets (MSDS) and Shipper’s Declarations.
Notice: Failure to declare hazardous or contraband cargo will result in immediate cargo refusal. The Customer shall remain fully liable for all fines, damages, penalties, and legal expenses incurred as a consequence.
4. Quotations, Freight Rates & Surcharges
- Freight quotations provided by the Company are estimates based on rates, carrier schedules, fuel indices, and currency exchange rates applicable at the time of quotation.
- Quotations are subject to carrier space availability, equipment supply, and confirmation at time of actual cargo handover.
- Standard quotations exclude unplanned carrier surcharges (e.g. BAF, CAF, Peak Season Surcharges), port terminal storage, detention, demurrage, customs examination fees, quarantine charges, or statutory duties unless explicitly specified.
5. Invoicing, Payments & General Lien
Invoices are payable within the agreed credit terms or prior to the release of original shipping documents / delivery orders (DO). In the event of non-payment or default, Shubhak Logistics shall have a general and particular possessory lien on all cargo, documents, and bills of lading in its custody for all sums owed by the Customer, including storage, legal fees, and auction costs where permitted by law.
6. Cargo Liability & Marine Cargo Insurance
The liability of Shubhak Logistics and its contracted carriers for cargo loss, shortage, or damage is strictly limited by statutory and international conventions governing multimodal carriage:
- Ocean Carriage: Governed by the Indian Carriage of Goods by Sea Act, 1925 / Hague-Visby Rules.
- Air Carriage: Governed by the Carriage by Air Act, 1972 / Warsaw and Montreal Conventions.
- Road Carriage: Governed by the Carriage by Road Act, 2007.
Cargo Insurance Recommendation: Because statutory carrier liability is capped at nominal amounts per package or per kilogram, we strongly advise all shippers to arrange comprehensive All-Risk Marine/Cargo Insurance for the full commercial value of their consignments.
7. Delays & Force Majeure
The Company shall not be liable for cargo delivery delays, transit schedule variances, or missed connections resulting from events beyond our reasonable commercial control, including but not limited to: acts of God, maritime accidents, adverse weather, typhoons, port congestion, strikes, labor disputes, customs inspections, border closures, war, civil unrest, or governmental embargoes.
8. Shipment Tracking Representation
Shipment tracking indicators on our website provide reference status data for informational convenience. Formal proof of delivery and official milestone certifications are validated through original carrier discharge receipts and carrier manifests.
9. Governing Law & Jurisdiction
These Terms & Conditions and all contracts for logistics services entered into with Shubhak Logistics Private Limited shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, India.
